These Terms of Use govern access to and use of the 10Yi web application ("Platform"), operated in connection with EMB Lenders LLC.

By accessing or using the Platform, you acknowledge and agree to these Terms of Use.

Purpose of the Platform

The Platform is designed to facilitate the 10Yi Program and may provide educational information, mortgage-related analyses, financial scenarios, property and credit-related information, document management, and other tools intended to assist participants and authorized EMB Lenders representatives.

No Guarantee of Results

• Mortgage approval or availability of financing;
• A particular interest rate, loan amount, payment, or loan program;
• A specific property value or amount of available equity;
• Elimination or reduction of debt;
• Payment of a mortgage within a particular period;
• Acquisition of an investment property;
• Generation of rental or passive income;
• Appreciation of real estate;
• Investment performance; or
• Any particular financial result.

Information, calculations, strategies, projections, illustrations, and scenarios presented through the Platform are provided for informational and educational purposes. Actual results will vary according to individual circumstances and future market and economic conditions.

No Commitment to Lend

Use of the Platform, completion of an 10Yi analysis, discussion of a financing strategy, or presentation of a potential mortgage scenario does not constitute an approval, commitment to lend, or guarantee of financing.

Mortgage financing is subject to applicable loan application requirements, lender guidelines, underwriting, verification, credit approval, property eligibility, and program availability.

Estimates and Third-Party Information

Property values, mortgage balances, equity calculations, credit information, interest rates, closing costs, investment assumptions, projected cash flow, and other figures appearing in the Platform may be estimates or may originate from third-party sources.

EMB Lenders does not guarantee that third-party information is complete, current, or error-free. Users should review their information and promptly report material inaccuracies.

Not Investment, Tax, Accounting, or Legal Advice

EMB Lenders LLC is acting as a licensed mortgage broker where mortgage brokerage services are provided.

Unless separately stated and appropriately licensed, neither EMB Lenders nor the 10Yi Program is acting as an investment adviser, securities broker, tax adviser, accountant, or attorney.

Information provided through the Platform should not be interpreted as investment, securities, legal, tax, or accounting advice. Users should consult appropriately qualified professionals before making decisions in those areas.

User Responsibilities

• Provide accurate and complete information;
• Maintain the confidentiality of usernames, passwords, and authentication credentials;
• Access only information they are authorized to access;
• Not attempt to circumvent Platform security or access controls;
• Not copy, scrape, distribute, modify, reverse engineer, or misuse Platform information or functionality except as expressly authorized; and
• Promptly notify EMB Lenders of suspected unauthorized access.

Intellectual Property

The 10Yi name, program methodology, branding, content, analyses, graphics, workflows, materials, and other proprietary content made available through the Platform are owned by or licensed to the applicable rights holder and are protected by applicable intellectual-property laws.

Access to the Platform does not transfer ownership or grant permission to reproduce, distribute, commercialize, or create derivative works from proprietary 10Yi materials except as expressly authorized in writing.

Platform Availability

EMB Lenders does not guarantee uninterrupted or error-free access to the Platform. Access may be suspended or restricted for maintenance, security, regulatory, technical, or operational reasons.

Privacy

Use of the Platform is also subject to the Privacy Policy and applicable EMB Lenders GLBA Privacy Notice.

Governing Law

These Terms shall be governed by applicable federal law and, to the extent not preempted, the laws of the State of Florida.
